We are a Dutch business and operate our webshop through Shopify.

 

2. Applicability

These Terms apply to all offers, products, services, and agreements made through Noordzee Boardstore and to every purchase made through the Site.

By placing an order, you confirm that you have read, understood, and agreed to these Terms.

By placing an order, you also confirm that you are at least 18 years old, or that you have permission from a parent or legal guardian to enter into a purchase agreement.

 

3. Products and Pricing

  • All prices are listed in euros (€) and include VAT unless stated otherwise.
  • We do our best to keep product information accurate, but occasional errors in descriptions, pricing, or stock may occur.
  • If an error is found after your order has been placed, we will contact you as soon as possible to correct the error or cancel the order and refund any payments made.

 

4. Orders and Payments

  • Orders are placed securely via our Shopify platform.
  • Payment methods include major credit cards, iDEAL, PayPal, and other options shown at checkout.
  • Payments are processed securely through PCI-compliant systems and payment providers.
  • Once your order has been placed and payment is confirmed, you will receive an order confirmation by email.
  • We reserve the right to refuse or cancel any order in case of suspected fraud, incorrect personal details, stock unavailability, or obvious pricing errors.
  • Retention of title: Products remain the property of Noordzee Boardstore until full payment has been received.

 

5. Shipping and Delivery

  • We ship within the Netherlands and to select EU countries.
  • Shipping costs and estimated delivery times are displayed during checkout.
  • Orders are dispatched as soon as possible after payment confirmation.
  • Delivery times are estimates only and may be affected by courier delays or circumstances beyond our control.
  • If your order arrives damaged, please contact us within 48 hours of delivery with photos and details.

 

6. Right of Withdrawal (Returns)

If you are an EU consumer, you have the right to withdraw from your purchase within 14 days after receiving the goods, without giving any reason.

6.1 How to exercise your right of withdrawal

  • Notify us at info@noordzeeboardstore.nl before the 14-day period ends.
  • Return the items within 14 days after notifying us.
  • Items must be unused, in original condition, and (where reasonably possible) in original packaging.
  • You are responsible for return shipping costs, unless the item was delivered damaged or incorrect.

6.2 Handling and diminished value

You may inspect the product only to the extent necessary to establish the nature, characteristics, and functioning of the goods. We may deduct from the refund any diminished value resulting from handling beyond what is necessary for inspection.

6.3 Refunds

Once we receive and inspect the returned product, we will refund your payment (excluding the original shipping costs) within 14 days. We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is earlier.

6.4 Exceptions

The right of withdrawal does not apply to:

  • Custom-made or personalized items
  • Sealed products that are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery (for example, wetsuits that have been worn)

 

7. Warranty and Complaints

All products come with the legal guarantee under Dutch and EU law. This means the product must do what a consumer may reasonably expect.

If you discover a defect, please contact us within a reasonable time at info@noordzeeboardstore.nl and include your order number and a description (and photos if possible). We will assess the issue and provide an appropriate solution (repair, replacement, or refund) in accordance with applicable law.

 

8. Liability and Safety

Surfing and the use of surf-related equipment involve inherent risks. Customers are responsible for using products in accordance with instructions, warnings, and safety guidelines, and for assessing their own skill level, local conditions, and suitability of equipment.

  • Noordzee Boardstore is not liable for indirect or consequential damages, such as loss of profit, loss of opportunity, or business interruption.
  • Our total liability is limited to the value of the product in question, except where mandatory law provides otherwise.
  • We are not responsible for injuries or damages resulting from improper use, misuse, or failure to follow instructions for surfboards, wetsuits, or related equipment.

 

9. Privacy and Data Protection

We care about your privacy. Personal data is handled in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

 

10. Intellectual Property

All images, texts, logos, product photos, and designs on the Site are the property of Noordzee Boardstore or our partners and are protected by intellectual property laws. You may not reproduce, copy, distribute, or otherwise use our content without our prior written permission, except where permitted by mandatory law.

 

11. Governing Law and Disputes

These Terms are governed by the laws of The Netherlands.

In case of disputes, we will try to resolve them amicably first. If no agreement is reached, disputes shall be submitted to the competent court in The Hague, The Netherlands, unless mandatory consumer law provides otherwise.

 

12. Force Majeure

We are not liable for any delay or failure to perform our obligations if such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, severe weather, fire, strikes, transport disruptions, supplier shortages, power or internet outages, and government measures. If a force majeure situation continues for an extended period, we may cancel the affected order and refund any payments received.

We may update these Terms from time to time. The latest version will always be published on our website with the date of the last update clearly shown.
